Legal Grounds for Mediation in Vietnam
Mediation in Vietnam is supported by clear legal frameworks, with the primary foundation being Decree 22/2017/ND-CP on Commercial Mediation. This decree establishes the legal basis for mediation in commercial disputes, allowing businesses to resolve conflicts quickly and privately. It outlines the qualifications of mediators, the procedures for mediation, and the enforceability of mediated agreements.
In addition to Decree 22, other laws such as the Law on Commercial Arbitration 2010 and the Civil Code 2015 recognize and promote mediation as a voluntary, efficient, and enforceable way to settle disputes. These legal grounds ensure that mediation is a trusted, legitimate alternative to litigation in Vietnam
