What is a Mediation Brief?
A mediation brief is a written document submitted before the mediation process, summarizing the key issues, facts, and arguments of a case. It helps the mediator understand the core aspects of the dispute and the perspectives of each party. The brief provides a framework for the mediator and helps the parties streamline discussions, which can lead to more productive and focused negotiations.
Why Knowing How To Draft An Effective Mediation Brief is Important?
Writing an effective mediation brief is crucial because it lays the foundation for a successful mediation session. By clearly stating your client’s position, legal arguments, and desired outcomes, you help ensure that the mediator is well-prepared to facilitate the conversation. Additionally, a well-crafted brief can set the tone for a cooperative rather than adversarial approach, increasing the chances of reaching an agreement.
